20. ENVIRONMENTAL LAW IN THE MAGHREB CONTEXT

This paper explores the development of environmental law and governance in the Maghreb region, with a focus on Morocco, Algeria, and Tunisia. These countries confront comparable environmental issues, including the lack of water, desertification, and climatic vulnerabilities, and have agreed to introduce legislation reform to be in line with the global trends. Relying only on secondary information, the research applies qualitative comparative analysis to assess six factors, namely legal regulations, methods of implementation, institutional design, limitations, performance metrics, and governance systems. As a result, it is found that although Morocco leads in terms of climate-related policies and legislative modernization, it encounters difficulties regarding law enforcement on the ground. On the other hand, Tunisia is characterized by high participation rates among civil society organizations and innovative constitutionality but suffers from a lack of political stability. Meanwhile, Algeria demonstrates a sound legislative base but experiences obstacles related to centralized government and its excessive reliance on hydrocarbon resources. In conclusion, a consistent mismatch between legislation and its execution remains a key problem in the region, while institutional capacity building, citizen involvement, and cooperation between sectors are of particular importance. Some of the policy suggestions include harmonization of laws, decentralization, greening the economy, and regional cooperation.
