6. WHISTLEBLOWERS PROTECTION IN KUWAIT: BRIDGING THE GAP BETWEEN LEGAL FRAMEWORKS AND PRACTICALITY

Whistleblower protection is a cornerstone in any framework that seeks to foster integrity and transparency. International experiences have shown that whistleblowers act as the first line of defence against corruption, contributing significantly to the early detection of irregularities and safeguarding public funds. In Kuwait, this issue gained strategic importance with the establishment of the Kuwait Anti-Corruption Authority “Nazaha” and the enactment of Law No. 2 of 2016. However, practical challenges continue to hinder effective implementation. This study explores the Kuwaiti legal framework for whistleblower protection, tracing its historical legislative development and assessing its alignment with international standards. It also provides comparative insights from Arab, Western, and Asian experiences. Furthermore, the paper examines the role of national institutions, such as the State Audit Bureau and the judiciary, alongside cultural and procedural obstacles limiting the scope of protection. The research concludes that Kuwait must advance its legal framework, strengthen institutional and technological mechanisms, and build greater societal trust in oversight bodies, while drawing lessons from pioneering international models. Practical recommendations are presented to bridge the gap between legal texts and actual enforcement, positioning whistleblower protection as a vital pillar in Kuwait’s national anti-corruption strategy.
